Citizenship may also be lost through renunciation — where a person formally applies to the Minister of Home Affairs to be released from their South African citizenship, often as a requirement of the foreign country granting them citizenship.

The Legal Framework for Restoration

Section 13 of the South African Citizenship Act makes provision for the restoration of South African citizenship. An application for restoration can be made to the Director-General of the Department of Home Affairs. The applicant must establish that they meet the requirements for restoration, which differ depending on the basis on which citizenship was lost.

Who Can Apply for Restoration?

Broadly, the following categories of persons may apply for restoration of South African citizenship:

•  Persons who lost citizenship through the acquisition of foreign citizenship before the 2010 amendment to the Citizenship Act.

•  Persons who formally renounced their South African citizenship and subsequently wish to resume it.

•  Persons born in South Africa to South African citizens who lost citizenship through no fault of their own.

The process involves submitting a formal application to the Department of Home Affairs together with supporting documentation, including proof of previous South African citizenship, your foreign passport, proof of identity, and any documentation relevant to the circumstances of loss. The Minister of Home Affairs retains discretion in considering restoration applications.
